1. Conclusion and subject matter
The general terms and conditions are an integral part of the entire driver training. They come into effect upon registration (in writing, verbally, by telephone or online) and end automatically after successful completion of the practical test or premature, written termination of the business relationship.
For the sake of readability, only the masculine form is used in the following text. However, all of these terms always include the feminine or neutral form as well.
2. Main service
The Rinderli driving school offers learner drivers high-quality, recognized training that meets the requirements of the Swiss Road Traffic Licensing Ordinance (VZV). The driving instructor holds a Swiss federal professional certificate and a driving instructor's license issued by the road traffic office. He conducts the training according to the latest, recognized standards. Practical driving lessons are given in a specially equipped and inspected training vehicle. The instructor's personal performance is not a requirement for the lessons, and an equally qualified instructor may be assigned.
The driving school cannot guarantee that the student will obtain a driver's license. Driving lessons are non-refundable, even if the test is failed.
The driving school has the legally required insurance coverage during the training period. The learner driver is personally responsible for obtaining mandatory insurance coverage for private driving lessons and practice drives in their own vehicle.
3. Cancellations, postponements, absences
Appointments can be rescheduled or cancelled free of charge up to two business days before the scheduled date (excluding Sundays and public holidays). If the appointment is rescheduled or cancelled less than two business days in advance, the agreed-upon time will be charged or deducted.
4. Termination and Cancellation
If the driving school terminates the business relationship for good cause, any purchased but unused driving lessons will be forfeited. A refund is not mandatory.
The same applies if the learner driver completes their training. Any driving lessons purchased but not yet used expire and do not need to be refunded.
5. Payment terms
Individual lessons/driving lessons and subscriptions must be paid in advance. Unless otherwise agreed in writing, invoices are payable upon receipt.
If all services are not paid for before the start of the driving test, the test will not be taken. In this case, the costs for any missed driving lessons will be borne entirely by the learner driver. The same applies to the test fees, which will be invoiced separately and directly by the road traffic office.
6. Lessons, training check, unavoidable impediment on the part of the driving school
A driving lesson includes greeting, setting up the student in the vehicle, providing information about the content and goal of the upcoming driving lesson, and repetition of the theoretical and practical knowledge from previous driving lessons.
Each learner driver has a personal training record (digital or analog). This record details the driving lessons completed and the skills practiced and achieved. Every driving lesson is documented/commented on this training record.
If the driving school has to cancel a driving lesson through no fault of its own (e.g., due to a technical defect, illness of the driving instructor, or due to the fault of a third party (e.g., partner organizations involved in conducting the lesson), it can be rescheduled for a later date. The lesson is not considered to have been taken by the student. The student is not entitled to compensation. This also applies if cancellation was only possible at short notice or after the fact.
If the driving instructor has legitimate doubts about a student's ability to drive (particularly due to fatigue, illness, insufficient mental state, influence of drugs or alcohol, lack of concentration, etc.), the driving lesson will be terminated immediately by the instructor. The lesson will then be considered completed. The student is not entitled to a refund.
Without a valid learner's permit, the driving lesson will not start, will be considered taken and will be entirely at the student's expense.
7. Practical driving test/check drive
The driving school/driving instructor ultimately decides whether a learner driver is ready for the driving test. If a learner driver is not ready for the test by the scheduled date, the appointment will be postponed/cancelled. Any costs incurred will be borne by the learner driver.
The learner driver is generally not entitled to the driving school vehicle during driving tests or official control drives. This applies regardless of the number of driving lessons taken.
If a driving test cannot be taken, the learner driver must cancel at least five working days before the test date. If cancellation is not made in time and costs are incurred as a result, these costs must be borne in full by the learner driver. This also applies if medical reasons prevent the driving test.
8. Admission to the 3rd practical driving test
Registration for a third practical driving test can only be arranged by a driving instructor. Only if the driving instructor has given their consent can the learner driver take the third practical driving test.
9. Applicable Law
All legal relations between driving students and driving schools are governed by Swiss law. The place of jurisdiction is the driving school's registered office. The driving school reserves the right to bring legal action against the driving student before any other competent court.
